These Terms of Service (the “Agreement”) are entered into between

or legal entity that creates an account or purchases services on tiklaweb.net (the “Customer”).

“Services” means web hosting, servers, domain registration, SSL certificates, business email, and software/licence
products, together with related support. “Client Area” means the online account through which the Customer manages
their services.
2. Subject and Scope
This Agreement sets out the rights and obligations of the parties regarding the provision and use of the Services the
Customer orders. The type, term and price of each service appear in the order summary. This Agreement forms a whole
with the Distance Sales Agreement, Acceptable Use Policy, Refund
and Cancellation Policy, Domain Registration Agreement, Service Level and Backup Policy, Personal Data and Privacy Agreement and Cookie Policy.
3. Account and Formation of the Agreement
- A person creating an account or placing an order must be at least 18 years old and have legal capacity. A person
acting for a legal entity declares that they are authorised to represent it.
- The Customer must provide accurate, complete and current information, including name or company name, national
ID or tax number, address, phone number and email. The Customer bears the consequences of incorrect or
incomplete information, including any loss of rights in domain registrations.
- The Agreement is formed when the Customer confirms the order and accepts this Agreement and the related
policies. A service is activated once payment has reached TiklaWeb.
- The Customer is responsible for keeping their Client Area password and other credentials confidential, and must
report any unauthorised use of the account to info@tiklaweb.net immediately.
4. Fees, Invoicing and Payment
- Billing period: Unless the order summary states otherwise, fees are charged in advance for
annual periods and invoiced annually.
- Payment methods: Credit/debit card through the PayTR secure payment infrastructure (domestic
and international cards), bank transfer, and account credit. Card details are not seen or stored by TiklaWeb;
payments are processed by the payment institution.
- Account credit: Prepaid balance that the Customer has loaded into the Client Area. It is used
to purchase TiklaWeb services, bears no interest and cannot be transferred. On the Customer’s request, unused
balance is refunded; only bank transfer or payment-institution transfer costs are deducted, and no other
deduction is made. The refund is made by the method used to load the balance, to an account in the Customer’s
name.
- Taxes: Unless stated otherwise at checkout, prices are shown excluding VAT; VAT and any other
statutory taxes are added to the total at payment. For foreign-currency payments the exchange rate at the time
of payment applies.
- Invoices: Invoices are issued electronically in accordance with Turkish law (e-Invoice /
e-Archive) and delivered through the Client Area and by email. The Customer is responsible for the accuracy of
invoice details.
- Price changes: TiklaWeb may change prices for new periods. The renewal price is shown on the
renewal invoice; the price of a term already paid is not changed.
5. Start of Service
Services are activated automatically after payment is confirmed or, at the latest, manually within a reasonable time.
For services that depend on approval by third-party organisations, such as domains and SSL certificates, activation
time depends on those organisations’ processing times.
6. Renewal, Due Date, Late Payment, Suspension and Deletion
- A renewal invoice is issued before the term ends and the Customer is notified by email. Tracking the end of the
term and making payment is the Customer’s responsibility; failure of a reminder email to arrive does not remove
the obligation to renew.
- Web hosting, servers and similar services: If payment is not made on the due date, the service
is suspended (access is stopped; data is not deleted). If payment is not made within
7 (seven) days of suspension, the service is cancelled and the account data is permanently
deleted. Deleted data may not be recoverable.
- Cancelled orders: Services cancelled by the Customer, or which the Customer has notified will
not be renewed, end on the last day of the paid period and the data is deleted.
- Domains: Renewal, redemption and deletion periods after expiry differ by extension (e.g. .com,
.net, .org, .com.tr) and by the rules of the relevant registry. TiklaWeb does not set or guarantee these periods; the renewal must be paid before the domain name’s expiry date. Details are in the Domain Registration Agreement.
- If any of a Customer’s services is overdue, TiklaWeb may decline new orders and defer renewing or provisioning
other services until payment is made. A domain remains registered in the Customer’s name; TiklaWeb does not
transfer it to itself for non-payment.
- TiklaWeb is not liable for data loss resulting from suspension or deletion, provided the notices and periods in
this Agreement have been followed.
Late payment fee: A one-time late payment fee of 10% of the invoice amount is added to an invoice that is not paid by its due date, starting from the day after the due date. The fee is applied only once per invoice; if the Customer also fails to pay another invoice by its due date, the fee is applied separately to that invoice. This fee does not affect our rights relating to suspension, cancellation and deletion of the service. Because the renewal and deletion periods of domain names depend on the registry’s rules, a late payment may mean that the domain name is not renewed and may enter the deletion process after expiry. The fee is applied within the limits permitted by applicable law; the statutory rights of consumer Customers are reserved.
7. Withdrawal and Refunds
The right of withdrawal and refund conditions are set out in the Refund
and Cancellation Policy and the Distance Sales Agreement. In
summary: domain registrations and SSL certificates are purchased in advance by TiklaWeb from third-party
organisations and cannot be taken back once registered or issued, so they are non-refundable. Other services, such
as web hosting, servers, email, software and licences, can be refunded within the period and for the valid reasons
stated in the Refund and Cancellation Policy. When software or a licence is refunded, the licence is cancelled, the
right to use delivered files and code ends, and the Customer must delete all copies. Mandatory consumer rights under
Turkish law are reserved.
8. Domains and SSL
- A domain is registered in the Customer’s name with the relevant registry or registrar based on the information
provided at registration; the right to use the domain belongs to the Customer. The Customer accepts that domains
are subject to the rules of the relevant extension, ICANN, and the .tr registry policies.
- Domains and SSL certificates are obtained by TiklaWeb from third-party suppliers. Therefore a domain or SSL
service whose registration or issuance has been completed is non-refundable.
- Tracking a domain’s expiry date is the Customer’s responsibility. TiklaWeb is not liable for domains lost
because they were not renewed in time.
9. Web Hosting and Server Use
- Shared and reseller hosting customers accept sharing server resources with other customers. If an account uses
CPU, memory, I/O, process or disk resources in a way that affects other accounts, TiklaWeb may first notify the
Customer and ask them to reduce usage, upgrade the plan or move the site to another server; in urgent and
serious cases it may temporarily restrict or suspend the account.
- For server services (VPS/dedicated), TiklaWeb is responsible for the hardware and network infrastructure. The
operating system, installed software, configuration, security updates and all content on the server are the
Customer’s responsibility; TiklaWeb is not obliged to perform these tasks unless a management service is
purchased separately.
- Plan limits (disk, traffic, email, databases, etc.) are stated on the product page. Resources described as
“unlimited” are subject to a fair-use principle.
10. Backups
TiklaWeb backs up web hosting and reseller hosting accounts weekly as standard. These backups do not
replace the Customer’s own backups and are an ancillary feature, not a commitment of the service; TiklaWeb gives no
guarantee that backups will be made, kept or restorable. The Customer is obliged to keep a current backup of their
own data. More frequent backups can be arranged for an additional fee. Details are in the Service Level and Backup Policy.
11. Acceptable Use
The Customer may not use the Services in any way that is unlawful, contrary to public morals, or contrary to the Acceptable Use Policy. In particular, the following are prohibited:
publishing unlawful content; sending spam (unsolicited bulk email) or supporting spam; distributing or hosting
viruses, malware, DDoS or attack tools; phishing and fraud; unauthorised access to other accounts or systems;
publishing content that infringes intellectual property rights (warez, pirated software, unlicensed images or
music); running IRC servers and similar services prone to abuse; and unlawfully collecting or processing personal
data.
12. Content Responsibility and Unlawful Content
The Customer alone is responsible for all content, email, files and software published on the Services. As a hosting
provider under Turkish Law No. 5651, TiklaWeb has no duty to monitor hosted content or to investigate unlawful
activity, but it may remove or block access to content upon valid notice from competent authorities or rights
holders, and it provides legally required information to competent authorities. Where unlawfulness is suspected,
TiklaWeb may restrict or terminate the service, notifying the Customer beforehand where possible.
13. Customer’s Security Obligations
The Customer must keep the software they use (CMS, plugins, themes, etc.) up to date, use strong passwords and keep
their account secure. TiklaWeb is not liable for breaches caused by the Customer’s negligence or by vulnerabilities
in third-party software. A Customer who suspects that their account has been compromised must inform TiklaWeb
immediately.
14. Service Level and Maintenance
TiklaWeb uses reasonable efforts to keep the Services running without interruption or error but does not guarantee
uninterrupted access. Planned maintenance is announced in advance where possible. Outages caused by third-party
infrastructure, the internet backbone, the domain name system (DNS) and force majeure are outside any service-level
commitment. Details are in the Service Level and Backup Policy.
15. Limitation of Liability
Without prejudice to liability that cannot be limited by law (intent, gross negligence and mandatory consumer
rights), TiklaWeb’s total liability under this Agreement is limited to the amount the Customer paid for the service
that caused the damage during the relevant period. TiklaWeb is not liable for indirect damages, loss of profit, data
loss, loss of reputation, or damages arising from the Customer’s obligations to third parties. This clause applies
to business customers; a consumer’s mandatory rights under law cannot be limited by it.
16. Third-Party Service Providers
To provide the Services we may work with third parties such as payment institutions, domain and SSL suppliers, email
and SMS delivery providers, and support and security infrastructure providers. TiklaWeb is not liable for outages or
errors in those parties’ services unless TiklaWeb is at fault. Sharing of personal data with these parties is
described in the Personal Data and Privacy Agreement.
17. Intellectual Property
All intellectual property rights in TiklaWeb’s name, logo, software, designs and content belong to TiklaWeb or its
licensors. The Customer retains rights in their own content and permits its processing to the extent necessary to
provide the Services. Software and licence products are subject to the terms of the relevant licensor; use of
unlicensed or pirated software is prohibited.
18. Personal Data Protection
Personal data is processed in accordance with Turkish Personal Data Protection Law No. 6698 (KVKK). More information
is in the Personal Data and Privacy Agreement and the Cookie Policy. The Customer acknowledges that, for the personal data of third
parties contained in content they host, they are the “data controller” and will meet their legal obligations.
19. Termination and Suspension
- The Customer may submit a non-renewal or cancellation request at any time through the Client Area or by writing
to info@tiklaweb.net; the service ends at the end of the paid period. Refunds are governed by the Refund and
Cancellation Policy.
- TiklaWeb may restrict, suspend or terminate the service in the event of a breach of this Agreement (in
particular clauses 11, 12 and 13), non-payment, a decision of a competent authority, or where the service
seriously harms other customers or the infrastructure. Where possible, notice is given beforehand; in urgent
security or unlawfulness cases, notice may be given afterwards. In case of termination for just cause, the
amount paid may not be refunded.
- After termination, the Customer’s data is deleted according to the periods in clause 6. Statutory retention
obligations are reserved.
20. Force Majeure
Natural disasters, war, terrorism, strikes, epidemics, power or internet infrastructure failures, cyber attacks,
decisions of competent authorities and other events beyond the parties’ reasonable control are force majeure. During
force majeure the parties are not liable for their obligations.
21. Changes
TiklaWeb may update this Agreement due to changes in legislation, technical requirements or changes to the scope of
the Services. Material changes are notified through the Client Area or by email and take effect when the new version
is published, and for terms already running, after a reasonable period following notice. A Customer who does not
accept the change may choose not to renew the service.
22. Notices
Notices sent to the Customer’s registered email address are deemed written notices and are served on the date of
sending. The Customer must keep their email and contact details up to date. Notices to TiklaWeb may be sent to
info@tiklaweb.net or to the postal address above.
23. Governing Law and Jurisdiction
This Agreement is governed by the laws of the Republic of Türkiye. A Customer who is a consumer may apply to consumer
arbitration committees within the monetary limits announced annually by the Ministry of Trade, and otherwise to
consumer courts; the competent authority is determined under the Consumer Protection Law. For business customers,
the Istanbul (Küçükçekmece / Bakırköy) Courts and Enforcement Offices have jurisdiction.
24. Entry into Force
By creating an account or placing an order, the Customer declares that they have read, understood and accepted this
Agreement. The Agreement takes effect on the Customer’s acceptance and remains valid for the service term.
